CHARLOTTE, N.C. -- A mistrial was declared in the trial of three men charged in an alleged June 17 assault of former NASCAR driver Mike Wallace, his adult daughter and son-in-law.Two potential witnesses were in the courtroom for part of the opening testimony Tuesday -- violating the sequestration order in the case -- and North Carolina District Court Judge Ronald Chapman determined their testimony could be influenced by what they saw.All I can hope is we will have an honest day in court, Wallace said afterward. One of the issues presented by the defense during the opening day of testimony was that Wallace was kicked in the head by someone wearing a boot and whether any of the defendants were wearing boots that night.The fact someone appears to have directly violated an order from the judge is too much for me to let pass, Chapman said when declaring the mistrial.The defendants -- Paul Lucas, Nathan Lucas and Randolph Mangum -- could face another trial, depending on whether prosecutors determine to retry the case.
